This appointment agreement requires that any new project (regardless of the number of units) and any transformation that produces three or more units, that have received public grants or are funded by an agreement under Section 106, should give the Commission 100% appointments for first leases and 50% for subsequent leases. In the event that a provision (or part of it) of these statutes is or becomes incompatible with a provision of the foundation certificate, the DGCL, another applicable law or the appointment agreement, the provision (or part of it) of these statutes is not acted on to the extent of this inconsistency, but it will be fully effective. The appointment agreement will therefore include a „Boiler Plate“ clause that will trigger a debate in the event of a proposed amendment to the law or directive, which could affect a resident`s ability to pay rent and service charges.
